EB-2 NIW for India: Does It Actually Speed Up Your Green Card?

It is one of the most common questions we hear, and the honest answer is: yes and no. The NIW genuinely speeds up one part of the process and gives you real freedom you would not otherwise have. But it does not shorten the part that hurts most for India: the wait for an available visa number. Let us walk through exactly what it does and does not do, in plain English, so you can plan without false hope or unnecessary worry.

First, what the NIW actually is

EB-2 is the employment-based second preference category, for people with an advanced degree or "exceptional ability." Normally an EB-2 green card requires an employer to sponsor you and to complete PERM labor certification — a Department of Labor process where the employer tests the U.S. job market to prove no qualified American worker is available for your role. That process is slow and ties you to one employer.

The National Interest Waiver (NIW) is a waiver inside EB-2. If you can show your work is in the U.S. national interest, USCIS waives both the job-offer requirement and the PERM labor certification. The standard comes from a 2016 case called Matter of Dhanasar, which set a three-part test: (1) your proposed work has substantial merit and national importance; (2) you are well positioned to advance it; and (3) on balance, it benefits the U.S. to waive the job offer and labor certification.

What the NIW really speeds up

Because PERM and the job offer are waived, you skip straight to filing Form I-140 (the immigrant petition). Crucially, you can self-petition — file the I-140 for yourself, with no employer sponsor required. This can save many months of recruitment and Department of Labor processing at the front end. So the NIW genuinely gets you to an approved I-140 faster.

The catch: it is still EB-2

Here is the misconception we most want to clear up. The NIW is a waiver within EB-2 — it is not a separate, faster category. Once your I-140 is approved, you join the exact same EB-2 India priority-date queue as every other EB-2 India applicant, including employer-sponsored ones. The NIW does nothing to the visa-number wait.

That wait exists because of the per-country limit: no single country may receive more than 7% of green cards in a category each year. India has far more demand than that cap allows, so a long backlog has built up. Your priority date (your place in line, set when your petition is filed) must become "current" on the monthly Visa Bulletin before you can take the final green card step. For EB-2 India, that wait is currently many years — the Final Action Date sits years in the past. The NIW does not move that date forward by a single day.

  1. If your goal is "get in line as early as possible," the NIW is excellent — it gets you an approved I-140 and a locked priority date faster.
