Changing Jobs With a Pending Green Card (AC21 Portability)
One of the hardest parts of a multi-year green card wait is feeling stuck at the sponsoring employer. The law anticipated this. AC21 portability (INA 204(j)) can let you change jobs without starting over.
The basic requirements
- Your I-485 has been pending for 180 days or more, and
- Your I-140 is approved (and stays valid), and
- Your new job is in the same or a similar occupational classification as the sponsored job.
What you keep
You keep your priority date and your place in line. You usually notify USCIS of the new job with Form I-485 Supplement J.
Why this matters in a long backlog
For applicants from heavily backlogged countries, the wait can run many years. AC21 is what makes it possible to take a promotion, switch employers, or move, without throwing away years of waiting, as long as the new role is genuinely same-or-similar.
Be careful
"Same or similar" is a legal judgment, the timing rules matter, and a withdrawn I-140 before approval can cause problems. This is a classic moment to get advice before you move.
