Not Selected in the H-1B Lottery? Your Options
Most people who enter the H-1B lottery are not selected. That is not the end of the road. Here are the most common alternatives, depending on your situation.
Other work visas
- O-1 (extraordinary ability): no annual cap, no lottery. For people with strong achievements in their field. Learn more about the O-1.
- L-1 (intracompany transfer): if your employer has a related office abroad, you may be able to work there for a year and transfer back. L-1 overview.
- TN (USMCA): for Canadian and Mexican professionals, no cap, no lottery. TN overview.
- Cap-exempt H-1B: universities, nonprofit research organizations, and affiliated employers can sponsor an H-1B any time, outside the lottery. Cap-exempt H-1B.
Go straight for a green card
- EB-1A (extraordinary ability) and EB-2 NIW (national interest waiver) let you self-petition without an employer or labor certification. EB-1A · EB-2 NIW.
Stay in status while you decide
Options like staying on a current visa, F-1 OPT/STEM OPT extensions, or changing employers may buy time. The right move depends heavily on your facts, so this is a good moment to get advice.
