EB-2 vs EB-3 for India: When Does a Downgrade Make Sense?
For India-born applicants, the EB-2 and EB-3 Final Action Dates do not always move together. At times EB-3 has been ahead of EB-2, which leads some people to consider an EB-3 "downgrade."
What a downgrade actually is
If your job qualifies for both EB-2 and EB-3, your employer can file a new I-140 in EB-3 using your existing priority date. If the EB-3 cutoff is more favorable, you may be able to file or approve your I-485 sooner, without losing your place in line.
The trade-offs
- EB-2 and EB-3 cutoffs can swap again later. A downgrade can backfire if EB-2 surges ahead.
- It usually means another I-140 filing (and cost).
- Some people keep both petitions alive to stay flexible ("interfiling").
